PhoBoCo Photo Booth Terms and Conditions

These Terms and Conditions (“Terms”) state the Terms of Service governing your use of and access to the Site and constitute a legally binding contract between you and PhoBoCo Photo Booth. These Terms incorporate any additional Terms posted by PhoBoCo Photo Booth through the Site, or otherwise made available to you by PhoBoCo Photo Booth.

1. Company Overview

PhoBoCo is a Maine-based photo booth rental company dedicated to providing exceptional photo booth experiences for a variety of events, including weddings, corporate events, private parties, and more. We specialize in offering state-of-the-art technology and personalized services to create lasting memories for your guests.

2. Services Offered

2.1. Photo Booth Rentals:

  • 360 Video Booth: Capture immersive 360-degree videos with high-resolution slow motion, LED lighting, and instant video sharing via text.

  • Beauty Mirror Booth: An interactive booth featuring a touchscreen mirror, customizable templates, unlimited prints, fun backdrops, interactive animations, and green screen capabilities for unique backgrounds.

  • Digital Selfie Booth: Take digital selfies and create animated GIFs, all shareable directly to social media. This booth offers customizable backgrounds and overlays for a personalized touch.

2.2. Additional Services:

  • Customized Backdrops and Props: Choose from our curated collection of themed backdrops and props to match your event's style. Custom designs are available upon request.

  • Event Branding: Add a personalized touch to your photos by including event logos, custom messages, or hashtags.

  • Attendant Services: Enhance your experience with a dedicated PhoBoCo attendant to assist guests, manage the booth, and ensure a smooth operation throughout your event.

3. Booking Process:

Online Booking: Visit our user-friendly online booking system to instantly check availability and book your desired photo booth for your event date and duration.

Deposit and Payment: Secure your booking with a non-refundable deposit of 50% of the total rental fee. The remaining balance is due 14 days before your event date. We accept major credit cards and debit cards for your convenience.

Contract Review: Once your booking is confirmed, you will receive a detailed contract outlining the agreed-upon services, pricing, and terms and conditions. Please review the contract carefully and sign to proceed.

4. Custom Quotes:

For events exceeding 5 hours, requiring multiple booth setups, or involving special feature requests beyond our standard packages, PhoBoCo offers custom quotes. This service includes personalized consultations with our team to tailor the photo booth experience to your unique requirements and event scale.

5. Target Audience:

We cater to a diverse clientele, including:

  • Individuals planning private events like weddings, birthdays, graduations, and family gatherings.

  • Corporate clients seeking creative and engaging entertainment solutions for company events, team-building activities, and product launches.

  • Event planners and organizations hosting conferences, galas, fundraisers, and other large-scale events.

6. Cancellation and Rescheduling:

Cancellation: Cancellations made 30 days or more before the event date receive a full refund, minus a processing fee of 10% of the total rental fee. Cancellations made within 29 days of the event date are non-refundable.

Rescheduling: Requests to reschedule your event date must be made at least 30 days prior to the original date. A $100 rescheduling fee applies, and booth availability for the new date is not guaranteed.

7. Damage and Liability:

The client assumes full responsibility for any damage to the rented equipment beyond normal wear and tear. PhoBoCo reserves the right to charge for the cost of repair or replacement of damaged equipment.

PhoBoCo is not liable for any personal injury or property damage that occurs during the event. The client is responsible for obtaining any necessary insurance coverage for their event.

8. Copyright and Usage Rights:

PhoBoCo retains the copyright to all photos and videos taken in the photo booth.

Clients are granted a non-exclusive license to use the photos and videos for personal use, including sharing on social media and creating personal albums.

Any commercial use of the photos and videos requires prior written consent from PhoBoCo.

9. Governing Law:

These terms and conditions are governed by and construed in accordance with the laws of the State of Maine.

10. Entire Agreement:

These terms and conditions constitute the entire agreement between PhoBoCo and the client and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Acceptance:

By booking a PhoBoCo photo booth, you agree to be bound by these terms and conditions.

12. Waiver

By booking a PhoBoCo photo booth rental, the client ("Client") agrees to waive and release PhoBoCo LLC ("PhoBoCo"), its employees, agents, representatives, successors, and assigns ("Released Parties") from any and all claims, demands, losses, liabilities, costs, and expenses (including attorney's fees and costs) of every nature, arising out of or relating to:

  • Use of Photo Booth: Client's use of the photo booth and any related equipment or services.

  • Guest Conduct: The acts, omissions, or negligence of any guest or invitee of Client attending the event ("Guest").

  • Photos and Videos: The capture, storage, use, dissemination, or publication of any photos or videos taken in the photo booth (collectively, "Content").

13. Indemnification

Client agrees to indemnify and hold harmless the Released Parties from and against any and all claims, demands, losses, liabilities, costs, and expenses (including attorney's fees and costs) arising out of or relating to:

  • Client's Breach: Client's breach of these terms and conditions.

  • Guest Conduct: Guest's acts, omissions, or negligence.

  • Unauthorized Use: Any unauthorized use of the photo booth, equipment, services, or Content.

  • Intellectual Property: Any infringement of any intellectual property rights.

14. Limitation of Liability

14.1. PhoBoCo's total aggregate liability arising out of or relating to this Agreement, whether in contract, tort, or any other legal theory, shall be limited to the amount paid by Client for the photo booth rental.

14.2. Exclusions: PhoBoCo shall not be liable for any indirect, incidental, consequential, or punitive damages, including, but not limited to, loss of profits, business interruption, or loss of data.

14.3. Third-Party Services: PhoBoCo shall not be liable for any acts or omissions of any third-party service providers used in connection with the photo booth rental.

15. Force Majeure

PhoBoCo shall not be liable for any delay or failure to perform its obligations under this Agreement due to any cause beyond its reasonable control, such as acts of God, natural disasters, strikes, labor disputes, war, terrorism, or government regulations.

16. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

18. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

19. Amendment

PhoBoCo reserves the right to amend these terms and conditions at any time without prior notice. The amended terms and conditions shall be effective immediately upon posting on the PhoBoCo website.

20. Termination

PhoBoCo may terminate this Agreement immediately upon written notice if Client breaches any of its terms and conditions and fails to cure such breach within ten (10) days of written notice.

21. Prohibited Activities

The following activities are strictly prohibited in or around the PhoBoCo photo booth:

21.1. Illegal Activities:

  • Possession, use, or distribution of illegal drugs or substances.

  • Carrying or displaying weapons of any kind.

  • Engaging in violence, threats of violence, or any other disorderly conduct.

  • Engaging in sexual misconduct, including but not limited to assault, harassment, or indecent exposure.

  • Promoting or engaging in discriminatory or harassing behavior based on race, religion, gender, sexual orientation, age, disability, or any other protected characteristic.

21.2. Damage to Equipment:

  • Tampering with, vandalizing, or damaging the photo booth equipment in any way.

  • Misusing the equipment, including using it for purposes other than its intended use.

  • Taking any actions that could compromise the safety or functionality of the equipment.

21.3. Inappropriate Content:

  • Capturing, displaying, or sharing any content that is:

    • Obscene, vulgar, or offensive to the general public.

    • Hateful, discriminatory, or promotes violence or harm.

    • Sexually explicit or suggestive in nature.

    • Infringes on any copyright, trademark, or other intellectual property rights of any third party.

    • Depicts or encourages illegal activity or the use of illegal substances.

    • Contains personal information of others without their consent.

  • Using the photo booth to promote or endorse any commercial products, services, or businesses without prior written consent from PhoBoCo.

21.4. Unauthorized Access:

  • Accessing the photo booth without a valid booking or authorized permission.

  • Attempting to bypass any security measures or access restricted areas.

  • Sharing or distributing access codes or other sensitive information with unauthorized individuals.

21.5 Consequences of Prohibited Use:

Any person engaging in prohibited activities will be subject to the following consequences:

  • Immediate Removal: Denial of further access to the photo booth and immediate removal from the event premises.

  • Liability for Damages: Client and/or guest may be held financially responsible for any damage caused to the photo booth equipment or other property.

  • Loss of Content: Any photos or videos captured during the prohibited activity will be withheld and may be deleted permanently.

  • Additional Fees: Client may be charged additional fees for the cost of repairs, security personnel, or lost revenue due to the incident.

  • Legal Action: PhoBoCo reserves the right to report the incident to law enforcement and pursue legal action to the fullest extent of the law.

22. Agreement

By booking a PhoBoCo photo booth, the Client acknowledges and agrees to these terms. The Client further agrees to hold harmless PhoBoCo and its affiliates from any and all liability arising from the violation of these terms by the Client or their guests.
